Hi,
I applied for Balance Transfer (BT) from DHFL to Bajaj Finance and is about to disburse. But now to process BT, Bajaj Finance requires NOC in their format which society is not ready to give. Bajaj Finance implied that if I can get the NOC atleast stating Society have no Objection for me to mortgage with Bajaj Finance then there will not be any legal issues. Society is not ready to give that in writing. Please suggest is there any law/byelaw/or under Society's act wherein I can show to Society Secretary / Chairman that it not wrong in giving in writing that its Ok for Society for me mortgaging with bajaj Finance.
Please advice on other alternatives/suggestion on way forward to get the issue resolved.
Thank You

Respected Sir/Madam,
My grandfather had left me some of his agricultural land property in west Bengal. The land property is mutated in his name, and he expired in 2003. He gave those agricultural lands to his brothers (who live in his village) for utilizing those. The deeds of those agricultural land properties were given to his brothers by my grandfather himself.
My father also expired in 2011 and I want to do the mutation of those land properties in my name as because I am the sole and original legal heir. I have the succession certificate (affidavit) done before the executive registrar in west Bengal, but I do not have the original deeds of these agricultural land properties. When I went to the brothers of my grandfather to ask for the original deeds they said that all deeds are lost and they cannot find those.
What should I do to get my name mutated in those land properties, with the available documents ?
Can I get my name mutated in these agricultural land property left by my grandfather only with the succession ceritificate (affidavit) done before the executive registrar ? without the original property deeds…
Please reply…

Hi,
In the year 2011 we had booked a plot (Plot Number 14) developed by Agrigold company in bangalore.
We have payed the full amount in three installments. Still now they dint get the plot registered in my name. And now the court has ordered Agrigold company not to do any type of business or transaction. The reason they gave me for not able to register the plot is the 40% of the plots are not released by BMICAPA as there is some pending work in developing the plot. Now how can I get the plot registered in my name. The reason for court to order Agrigold not to do any business or transaction is because, the company is involved in cheating common people by collecting deposits illegally

Dear Sirs,
Can you please clarify the following :
1. Can the Visakhapatnam municipal corporation(Andhra Pradesh) has the legal right of refusing to mutate property obtained by unregistered WILL and if "yes" under what statute???
2. If the immovable property is obtained by Mother under a unregistered WILL :
(a)can it be gifted under a valid gift deed and registered by mother in favour of sons and
(b)can the sons get it mutated subsequently on the basis of registered gift deed with Visakhapatnam municipal corporation,Andhra Pradesh , on the basis of the above registered gift deed??

Hello
I purchased a flat in Kharghar, Navi Mumbai whilst the building was under construction and received the possession in Dec 2014. At the same time I also managed to sell the property to a buyer. The buyers bank ICICI requires a builders NOC as the society has still not been formed. The builder is not providing this NOC and says that they have never done this and are not willing to take the risk. Where do we stand with this?
As per law NOC in state of Maharastra has been dismissed as a required document.
Please advise

Authenticity of gift deed when both parties are abroad
Hello Sir,
Query 1: We are planning to buy plot at Karnataka. It is in the name of Mr.Rajesh and his daughter Shweta who reside at USA (names are changed). Since they can't come to India for registration, Shweta has given a gift deed to her father Rajesh and inturn Rajesh given a gift deed his blood brother Girish, who also resides at USA. Girish would come to India for registration. Two gift deeds are executed in sub-registrar's office at Karnataka without their physical presence. They had given a power of attorney to a property dealer from Gujarat to execute the gift deeds. This power of attorney is registered at Gujarat. Is it safe to buy the property from Girish? Are there any risks in this deal? What should we aware of?
Query 2: Since the plot is in a corner and big, two of us want to buy it and split. Can we split it into two separate plots while registration itself? What is the process?
Pls let us know if you need any additional information.
Thanks in advance for your responses.
