Builder not responding

Dear Sir
In yr 2010 we 5 friends booked a flat at Titwala by paying 1 lakhs rupees each. The title, NOC, CC every thing is ok.
In the year April 2014 we completed the registration procedure & paid the builder 2 lakhs each.

As per Registration document the Yr. of completion of building mentioned is Dec 2015.

But till today the builder has not yet started the construction work.

Please help me to know how to proceed with such builder, what legal action can be taken against him, & how we all will be benefited.

You can send a Legal Notice to calling him to deliver possessing or refund your money with interest. If the builder would not comply as per notice then file a case in District Consumer Forum for deficiency of service, unfair trade practice and mental agony.

You can also lodge a complaint to the Police and file a Criminal Case u/sec.420,406 and 427 IPC in Judicial Magistrate Court.

Thanks for replying, I want to know getting the only interest doesn't solve my issue. Now the rates of property has gone up tremendously.
I want to know how much benefit I can get from the benefit.

You cannot claim benefit due to the changed situations or hike in price, you can claim nominal interest alone to the refund amount sought for.
