Joint house property , partition

We have joint property, 2 story house having 4 block of 3 rooms each, in my mother name.(deceased). Father also deceased. We have four brothers no sister. 2nd no. brother expired.(Legal heirs wife and 2 daughter). All legal heirs are major. We want partition of each block in each brothers name. What documents will be executed , is there any stamp duty registration fee applicable. We have another house single story in my mother name. Right now elder brother is acquire the house. We like to transfer this house in the name of elder brother. Is there any disclaimer is required from remaining 3 brother. In first case also how elder brother may give disclaimer to transfer the property in names of other 3 brothers.

Terrace rights

Hi, 2years I bought 2nd floor(top floor) in C.R.Park. as per my papers our'sis a barsati floor constructed almost 19years back. After moving in we came to know that the terrace is owned by the 1st floor owner and she has done illegal construction also on complete terrace. We asked her the proofs for the same which she denied. Please advice who has the legal right of the barsati floor terrace. What are the legal aspects which we should consider.

Exemption on long term capital gain tax

My mother(65yr old) had inherited a house from her maternal side which she sold in 2012.She invested a part of the proceeds in a land and a house in the year 2013.She had taken some loan from relatives during the construction of the house.Now she wasnts to sell off the land and construct a top floor on the house and pay off her debts. Will she be eligible for Exemption on Long Term Capital Gain Tax?It may be noted that she had only one residential house in 2012 and even now she has that single house which she purchased in the year 2013

Land registration & payment terms

Hi,

I want to purchase a freehold residential land in Ghaziabad,U.P for Rs.12,00,000 from an Individual seller on resale. This land is not approved by any developent authority. I have only Rs. 5,00,000 to pay now, and for payment of remaining Rs. 7,00,000, I and seller have decided to pay through monthly EMI of Rs. 10,000 for 840 months. Hence total amount i will pay Rs. 13,40,000 for that land which is inclusive of both principal and Interest.

I want the land to be registered on my name.
To execute a separate legal contract between me (Buyer) and Seller so that seller should entitle the recovery rights from me and I am obliged to pay the remaining balance amount payable on EMI of Rs. 10,000 for 840 months (Total 8,40,000) in cosideration of land of Rs. 12,00,000.

Please suggest me the best legal process to be followed which would entitle me (Buyer) the ownership right of the property and entitle the other party (the seller) the recovery rights of balance amount payable on EMI of Rs. 10,000 for 840 months (Total 8,40,000).

And please suggest me the process of land registration and sale deed execution while purchasing property in ghaziabad. How this sale will executed.?

Please address my both queries above.

Oral agreement

Sir, I bought one ground vacant land as undivided with my brother ten years back through bank loan and released the document. I agreed to give corner part of half ground but he not agreed to give the land for all deeds.
I sub divided the approved land in to 2 half grounds. Still he is creating problems so a lawyer advised me to go for oral agreements. Can I give the half ground of my land [ not registered ] to my wife as settlement deed without my brother knowledge and registration office will agree this deed for registration. If it is agreed by registrar can I sell or get loan for house construction ?. Please solve my problem. Thanks.

Transfer of flat

Which transfer out of the following options will be safe, less expensive i.e. stamp duty & registration charges etc:

(i) Gift of Flat from Nephew(Sister's son) to Mama(Sister's brother)

(ii) Gift of Flat from Nephew(Sister's son) to Mami(Sister's brother's wife)

(iii) Gift of Flat from Sister's son to Brother's son (cousins)

My father has given his only ancestor property to me with a gift deed and registered in sub registrar office 2% stamp duty & Registration fee.But My query is, Can my sister claim for her share legal?

Is the nominee of account holder equls to the legal owner

sir,
My grandfather has died recently, keeping some bank balance of which the nominee is my uncle. The Will(i.e gift deed) does not mention who is the owner of the money. Does the legal owner of that bank balance will be my uncle only or my father too. Can you please advice what i will do if my uncle does not want to give any share to my father.

Regarding cidco apartment owners association.

Hello Expert,

Ours is Cidco registered apartment in Navimumbai and comes under owners association named as "Sangam Apartment Owners Association".

Who is the appellate authority for Cidco registered "Owners association" apartment for any dispute with the existing managing committee.

The committee has continued with the post for more than 3.5 years and the president has continued 2nd term total more than 5 yrs and are not calling for the elections to elect the new committee.

Resident owners have collectively issued "No confidence motion" against the committee and called the elections with secret ballot. Now the existing committee is not ready to handover. Neither they accepted the intimation letter (about handover) and refused to acknowledged. What are the possibilities for the handover.

There are couple of cases registered in the name of existing committee and against the resident members by the existing committee which is being disputed in the court.

In this scenario is there any legal restrictions not to handover the committee since the case is being heard in the court. How far the local police can intervene and help in this matter. Who is the authority who can intervene to resolve to change the existing committee.

Your answers will help 130+ residents.
