Property matter

Hi Experts

This question is on behalf of my dear friend:

Background:
His Mother-in-law is class 1 legal heir, who is staying in the house which is in her husbands name. There are 3 siblings 2 daughters and 1 son. Son has never taken care of any of the parent and is now staying separately. The daughters have always taken care of the parents once they started working (10 years back). After the fathers death (5 years back) the daughters have taken care of the mother's need household and medical and all other expenses till date. Son has never contributed to anything before and till date.

Question:
1. Son now wants his share in his Fathers property. Is this possible. How ?

2. Mother does not want to give anything to her son but wants to transfer the property in her daughters name. Is this possible. How?

If the mother makes a will in her daughters name only can this be challenged by the Son.

What is the best way to close this issue.

Partition

Hello Experts,

A husband has acquired a property during his life time and the same property was gifted to his wife by way of a gift settlement deed. Now after 10 years the husband died and sons had filed a partition suit against the self acquired property. How far it is maintainable in the Court of Law. Plz suggest.

Thank You.

Power of attorny

My mother is 88 years old and is almost bed ridden. We are 4 brothers and no sister. My mother has made a Will according to which after her demise all her assets will be equally divided amongst 4 brothers. She owns a flat in registered CHS which is given on rent under Leave and License agreement. She has made notarised Power of Attorney on my name for the purpose of only registration of L&L Agreement .The Security Deposit and Monthly Rental Cheques are drawn in her favour and are deposited into her individual SB A/c. I have the following queries.
1.In the event of her demise during the licensed period what will be the status of the L&L Agreement ?
2.Can the Licensee continue to stay under the same Agreement?
3.How can we pay the Licensee his security deposit in the event of her demise?
Please advise !

Share certificate

I have purchased under construction 2 BHK flat in 2010. At the time of purchase I have kept my father as second owner. Our both names are reflected on Index 2. All the payments are occurred from my bank account. After 2 years (May 2012) from flat purchase my father made a gift registered agreement and transfer flat towards my name. We got flat possession in July 2013 and society was formed in Nov 2014. After society formation I have submitted both Index 2 to society and requested them to make update in there record and give me the Share Certificate accordingly. As per my request society has given me share certificate and mention only my name on share certificate. After couple of years when new society body formed they told me share certificate which was given to me by last society comity was wrong. They told me Share certificate must contained flat owners which was mention in first index2 document. Please advise me what should I do

Holding share certificates & possession ltrs for defaulter

Respected Experts,

The newly formed Co-Op.Housing Society is conducting society affairs
by the Provisional Committee which is appointed for one year period.

Now they have to issue SHARE CERTIFICATES to the members duly signed by them.

Additionally they have to handover official possession letters & copy of OC obtained from the Builder.

THE ISSUE IS, few members have done illegal construction, encroachment of society spaces, alteration in the flat etc. The Provisional committee has sent official letters to them to demolish/restore the same.

The Committee has decided not to issue SHARE CERTIFICATES or handover them possession letters till they demolish/restore the construction.

I would like to know whether is it correct action of the committee? and what are the implications and consequences.

Thanks in advance.

Yeradkar
