Power of attorny

(Querist) 15 March 2017 This query is : Resolved 
My mother is 88 years old and is almost bed ridden. We are 4 brothers and no sister. My mother has made a Will according to which after her demise all her assets will be equally divided amongst 4 brothers. She owns a flat in registered CHS which is given on rent under Leave and License agreement. She has made notarised Power of Attorney on my name for the purpose of only registration of L&L Agreement .The Security Deposit and Monthly Rental Cheques are drawn in her favour and are deposited into her individual SB A/c. I have the following queries.
1.In the event of her demise during the licensed period what will be the status of the L&L Agreement ?
2.Can the Licensee continue to stay under the same Agreement?
3.How can we pay the Licensee his security deposit in the event of her demise?

without the terms of leave and license agreement could not be able to comment. After demise of your mother the POA will automatically nullified. So only will only preveil. So the terms of will and lease agreement has to be looked into. So it is a matter of documentary consulation. better consult an advocate in person with documents

Refer the terms and conditions of the L & L.

1) Best to execute fresh agreement
2)If continue until expiry of LL, if licensee is reliable, make fresh agreement thereafter
3) Add yr name with mother's bank account as "either or surviver"
