Title Search Report

Hi,

Is any one can tell me in which offices one should go for the title search for property situated in Thane/Mumbai/Navi Mumbai

As for example for the old property situated in Borivali previously it was in Bandra and for the newer one search done in Borivali

As the credibility of Tital search report depends on the search made in different sub reg. offices
Or where I can get the complete list for this.

If some of the offices not covered than search report will not give correct details

How much IMP is collector approval for project?

Hi, I have booked one flat in Panvel. As per Builder, he had received approval from MMRDA for contruction and plan layout. But he is waiting for Collector approval. Need to know what is importance of Collector Approval? If it gets disapproved then will it cause any adverse effect in investment?

breach of contract in the agreement of earnest money paid

yesterday i had purchased the property, property at baroda (guj.), property is in the name of 80 yrs old lady who is living in america his son dealt with me through power of attorney whic was made in the year 2008 and in the power of attorney both the address are written , america as well as baroda's address now the matter is this that the buying amount of the property is 10 lac and i have paid him the 3 lac rupees as earnest money the balance amount will be paid after 3 months for which seller will again come for collecting the balance consideration and registration of the documents.
further in the agreement it is mentioned that if the buyer breach the contract than earnest money paid by the buyer to the seller will be forfeited but the penalty/damage clause for the breach of agreement by the seller is not mentioned.
therefore i would like to know that will there be any problem which may arise in future because of this.
secondly in future if the seller do not accept the remaining consideration due to any reason and can he later on say that it is breach of contract from the buyer's side that remaining consideration was not paid by the buyer.
what is the safety measures should be taken in this matter to fullfill the deal without any hitch. please suggest

Sharing of fathers property

my father has a self acquired property. he has passed away without writing a will. he has 4 children (two sons and two daughters) from first marriage. The eldest daughter is no more but her husband and her daughter are there. Another daughter is born in 1953 and is married and has a family of two children.

My father has two children from 2nd marriage ( one son & one daughter). Daughter is born in 1962. Wife is surviving

Please tell me what does the indian law says about sharing the property between children of first wife, share for the second wife, share for the children of second wife. Whether the daughters have equal rigts in the property. Whether the husband an daughter of eldest daughter (who is no more) has rights in the property?

Daughter's share

Dear All,

We are 5 member in family, My Father, Mother, Me, my Wife and sister.

My sister is not married but working with Salary of 18000PM

Under Influence of her friends she has already pressed charges of Physical violence, and mental tourture against me and my family.

My Salary is 20000PM and my father's pension is also 20000PM.

I had felt many times that she want share in father's wealth and this situation will be in front of us very soon.

Whatever wealth we have is earned by father and there is no ancestral property.

We have already given 1 bedroom flat+all household items+an alto in her name.

My Query is what is my father and family's laibility towards my sister. In case of calculating her share will it be the division of property only or total wealth earned by father. Also will the total wealth be divided in 2 parts (Me and my sister) or among all family members.

Even if she is earning 18000PM, will the conditions change to calculate the share or it doesn't matter if she earns or not.

Whether the money spent on my marriage be counted, and whether the money put aside for sister's marriage be counted in calculating her share.

Please let me know what law says about daughter's share in father's wealth.

one important query once the share is given to her, whether she owns a part on father's home as I read somewhere that unmarried girls cant be blocked to come on any reason.

Does widow daughter in law (do not have children) get share in
A) Father in law owned property?
B) Father in law ancestral property

1. Father in law / Mother in law expired with out writing will
2. Father in law has 2 alive sons and a daughter

Requirement of will

In 1950 my father in law signed an agreement retaining all the rights of the property(ancestral) to himself and his son (my husband). The agreemnet also stated that his wife and daughters will not get the rights to the property.

My Father in law died in 1990. Now, he did not make a will to his property as he had already registered the agreement in 1950 making his son(my husband) the only owner at the deletion of the sisters. It was a clear proof that he did not want the daugheres to get any share in the property.

Therefore to make sure that they are not deprived, he gave them Gold and Cash at the time of their marriages in 1962, 1967 respectively.

My husband had no brothers but had 2 sisters.

Do my husband's sisters have any rights?
