Hello Sir my grandmother has property in her name.She has two sons and three married daughters.She died without any will and also one son is died.I want to know who is the legal owner of property.The one survival son or the died son`s sons & daughters.
The deceased son`s family members are getting the property registered in there name without the survival son (my father) permission i want to know if that is possible or not if yes how to get the justice please reply...

Municipal Tax on Flat given on LL as per rateable vlaue

My flat in Mumbai is given on leave licence. Our CHS Society has recently sent me a notice claiming that B.M.C have levied Municipal Tax as per improved rateable value for the period 1/10/08 till 31/3/2011 and that I need to pay the same.
I understand that SC has put a stay on fixing property tax based on rateable value.
Would the learned panel kindly explain the status and since the tax levied is large Rs 2.95 lac what should I do under the circumstance.

Can a foreign national married to an Indian and living in India for the past 13 years co-own a house with her husband. The land/house was purchased in 2002.

Property Agreement

Dear Sir,



I have a query.



One month back i purchased two sites of dimension 30*40 ft size for Rs.2.4 lac each.At the time of registration,i faced shortage of amount,

so i requested the owner to register one site and to make agreement for the other one.

So i registered one site and made agreement for the other one by paying a cash amount of Rs. 10000 and fixing time of 3 months.

Now (One month completed) i have taken a loan and arrenged the money to register for the second site.I called him several times but he was giving unreasonable answers and avoiding me.

Agreement is having a time of three months(April-11 to 10-July-2011).



When & What action can i take?



Since the taken property was 320 Kms from my current residing place,i have already spent aroun 5 to 6 thousand on travelling.Can i get the expeses waht i have spent on travelling and boarding?
Compensation for harresment?



Please assist me.

Regarding disobedience of court orders

Sir,
In a property suit relating to possession and damages, the plaintiff although filed the above suit against his own blood related daughter and son-in-law merely by attaching a photostat copy of will of 18 years back on a plain paper which is unregistered. When the defendants under the provision of CPC has requested to direct the plaintiff to submit the original will and other original documents, the plaintiff on one pretext or the other not submitting these documents despite repeated court order and paying adjournment cost to the defendants. Under the above circumstances, can the defendants under CPC rules request the concerned court to dismiss the above suit under Rule.21 CPC or any other relevant provision. Please also refer judgements on the same matter delivered by higher courts.

Shop on Pagdi

A house was taken on pagdi system in the year 1988 and converted to a shop. The tenant has rented the shop to someone.
As the road level is high, the shop is flooded with water during the rains. When the tenant went to request the landlord to carry the repair work of increasing the height of the roof the Landlord refused and when the tenant was ready to do the repair at his own expense the landlord demanded money and increase in rent to give the permission to carry on the repair work. The tenant refused to pay the demanded amount. When the tenant went to pay the monthly rent ,the landlord did not accept the rent saying that they will only accept the revised rent. As the landlord did not accept the rent,was not giving permission to raise the roof height, was not doing any kind of repair work, was demanding money and increase in rent ,the tenant stopped paying the rent, it is 7 years now. Now the road height has further gone up and the shop is flooded with water during the rains and the roof is very low and it almost hits the head. The landlord is still uncooperative and demands Rs. 70, 000/- and rent @ Rs. 600/- per month for the past 7 years. Should the tenant accept the landlords demand or can they do something about it. Please advice.
