Dear Sir / Madam
My father had rented four of our shops without any agreement with the tenants. The shops were rented almost 35 years back. My father has been giving rent receipt to the tenants for the rent they have paid over the years.
Currently there is a case going on in the court for these shops. We have asked for vacating of the shops on the ground that we need the shops for our own use. The case has been going on for a long time now. Its almost been 8 years. The shops are located in the state of Uttar Pradesh.
My question is that can we do new construction on the roof of the shops? Do we need any kind of clearance and can the tenant raise any objection?
Please advise.

Hi,
We have just been handed over management of the our apartments (in Trivandrum) by the builder. He wants us to register the flats under the Travancore-Covhim Literary, Scientific and Charitable Societies registration act. Mu understanding is that though the Kerala Government has notified the Kerala Apartment Owners Act in 1984, steps to make it functional have not been taken.
Is this true ? is it not possible for us ?to register under KAOA 1984 ? If yes, who is the competent authority ?

1. Someone passed away young several years ago and his wife remarried. Their six year old son was adopted by the person whom she remarried.
2. Would the the boy be entitled to his biological father's share in the inherited property of his grandfather or any other property from his original family.

We are doing an investor proposal. The total land is around 100,000 sqft out of which 13,000 sqft has itsw own 7/12. We are funding amount equal to market value of 13,000 sqft . We are investing by doing JV with the builder. Below are some points
1. Land is currently not resiential zone, It was in residential zone when it was in Municipal limit, but now it is under Gram panchyat and the status is abeyance. It should get converted into yellow zone in 3 months and then NA will take place
2. In JV we will not own any liabilities thus covering ourselves
3. Builder will first develop 87,000 sqft of land
4. Builder will give ua power of attorney through which we can sell the land in 3 years, if something happens to project.
5. Since it is investor proposal, we shall get the apartments in the building constructed in any part of project at docounted rate (50% of market value) and then builder wil buyback from us, The first year is locking period The builder can buy back in second year or third year at the rate mentioned in agreement We reserved the rights for not selling it. After 3 years we can sell the apartment on our own to market.
Is there anything we need to be cautios of. DO we need the farmer status (in state of Maharashtra) to be able to go into JV? We are in pune, so if any one of the expert would like to offer their services, we are ready to undertake this.
Thanks

I am not a agriculturist nor any one from my family is. But i still what to buy an agricultural land in karnataka. I have no intension of converting the land to residential or something else. Basically plan to generate revenue from agriculture(banana, cashew, coconuts etc etc ). May be a small income initially but i think it wold work well in future.
I know in as per rules in karnataka its not possible if not an agriculturist. Let me know what can i do to be eligible. I would be needing loan as well. I would be planning to pay off the loan from my salary.

Woman X got a property from her father-in-law. She became a widow very early and passed away without having any children. Her Husband is the only child of his parents. She also haven't done any will of the property she inherited. Now, I am a tenant in her property for the last 36 years. 4 years ago I had a agreement with her of buying my portion in this term that I pay some amount of money at the time of agreement and the rest within next 10 years. Meanwhile she died. So the agreement could not be converted into a deed. My question is:
1) who could be the legal heir of her whole property in this case.
2) what am I going to do to claim my portion in this property.
3) what other advantage I could gain considering the fact I am the only person living in this property for such a long time.
