Our father died without writing a wil in 1995, and our mother too died without writing a will in 2007. Brother and his wife avioded all attemts at division of assets, since they were in posseson of everything, estate as well as business.
He and his wife indulged in mal treatment of mother and sister. mother died, but sister was saved, as the police got involved.
Dv case was filed against brother and his wife, where he refused to maintain the mentally unstable sister, while grabbing all assets of father. When she demanded her share of property, brother replied to court, that a wil had existed, dated 1994, and that everybody is aware of same and will has been acted upon. Whereas no will existed.
And all the assets are still in the name of my father.
He refused to attach a copy of the will along with documents ,along with reply to court !!!!!!!!!!!!!!!!
Kindly advice, whats the validity period of will ??????
How can we prove that the will he is talking about never existed .
And why is he allowed to file a reply like this without copy of will ????

I am living in Faridabad, working in Delhi and have a flat in Gurgaon. I want to rent out this flat. Can I buy stamp papers of Delhi for this flat in Gurgaon? Will there be any legal implications if tenant creates some problem? If so, which court of law we have to approach?

I am a foreign national previously holding Indian passport- and am interested in buying property that has been converted from agricultural use to commercial/residential under Section 90B in Rajasthan. The land-approximately 3000 gaj-is located in a village. Am I able to buy this land and have it registered in my name?
Last year I was going to buy a residential plot-1000 gaj-in a large town, but the local authorities did not know if they would be able to register it in my name.
Thank you for your response.

Dear Sir,
My father is having property dispute (in Rajasthan) with his brothers. The property is a Shop and market value of it about 80 Lacs. My grandfather died without writing any will for property distribution.
My father's brothers are not showing any willingness to resolve the issue with mutual consent and they take possession on property in their hands.
I and my brother are not living in town and working outside that may be one of the issues they do not want to resolve the issue and delaying it further and they keep on troubling my father by creating unnecessary fights.
Below are some of my queries, it would be great if I can get some answers to them:
1. Can we file a court case for distribution of property?
2. Is it possible to file court case for partail property distribution OR it needs to be file for all property at one go?
3. Can i claim monthly rent from our part of property from the possession holders of the shop/property ?
4. Can we file an application before the Municipality that if any application is received regarding transfer of that property then without our permission any transfer does not make ?
Please provide me advise as early as possible.
Regards

Dear Sir,
My father was an owner of MHADA flat Khar area, After his death when we applied for its transfer in my mother's name to MHADA office at Brandra they have directed us the society stating since it is now a society they will transfer it in my mother's name
My mother also owns a flat at Mahim which is not a MHADA flat also she was a working woman.
The society asking my mother to give them in writing that she does not have any other
property.
Can anybody please guide us what should we do..also that MHADA flat was originally owed by my father and only after his death, as his legal heir, we have requested to transfer it in my mother's name.
Appreciate your response.
Thanks and regards,
hello friends,
Can some body tell me what is difference between 'Agreement to Sell' & 'Sale Agreement'.
Friends, I am going to purchase a flat which is realloted to vendor by private builder.
Till date i have not make any 'Agreement to Sell' however before transfer I want to make a 'Agreement to Sell' wherein i am showing that i paid total consideration amount in one installment in cash.
One of my colleague is saying that as you are paying total consideration amount, it will be sale agreement not agreement to sell.
So tell me what will be right step for me, in view that vendor have to just tranfer flat in my name by way of re-allotment and then after buidler have to register sale deed in my name.
Also tell me if there is any other technicality involve in such a case.

Hi
I am the only son of my mother, who expired in 2004, and is owner of a property in Ludhiana. Recently, my father also expired. I am currently in New Delhi for my studies.
How do I proceed to obtain the Succession Certificate? Is a succession certificate necessary or a legal heir certificate can also solve the purpose?
My mother was unwell, and had to be taken to Delhi for treatment, where she died in Deen Dayal Hospital. So this is a case of death outside the native city of the owner, and will it require any NOC from someone in Delhi? My father died in the same property around 6 months ago.
I have the important documents like passports of my parents and my passport (though expired), ration card and my CBSE certificate that has both my parents name.
Please guide me about the steps I need to take to get the succession certificate.
Thanks
