My grand father has a son(expired, has wife and 2 sons) and my mother. All the properties on my Grandfather's name and PATTA is in joint with my deceased uncle and Grand father.
My grand father is willing to give the property equally to both the heirs and my uncle's family is opposing. and recently we came to know that the property has been transferred to my aunt and then to her sons without my grandfather's knowledge. What can be done here. Pls suggest!. This is in Tamilnadu, Dindigul district.
To add to the above we took EC from Sub-registers office in the year 2009, the property was in my grand fathers name but now it is not. we suspect they forged someone to appear as my grand father for property transfer. Since I am not at my home town, I will go to sub-registers office directly asking for explanation then take necessary action as appropriate.. Am I right? or any different move which is most appropriate?

Hello to all experts
My query is regarding rural property in Gujarat.
(1) Under what legislation is “gamtal land” & “gauchar land” defined in Gujarat .
(2) Whether Gamtal land can be mortgaged and what are the documents required to mortgage it in Gujarat. Whether any NOC is required from Sarpanch/Talati of Gujarat.
(3) How can one inform the general public that the particular gamtal land has been mortgaged. Where can the mortgage be recorded.

five brothers are holding 80 bighas of agriculture land in delhi . all of them are in physical posession on site of 16 bigha each but on the land which they are sitting or are in their posession is/are in the name of other brothers in the record . in other words the land on which the one brother is sitting / having physical posession is not in his name in the revenue but in the name of other brothers . some of the land is deh saamlat ( in joint names of brothers ) . the two of the five brothers have died but befoore their death they had executed the will on the basis of which their legal heirs have got the property mutated in their name . now all of them wants to transfer the said lands on which they are sitting or are in their posession through a family settlement deed . now my query is :-
1. can a family settlement deed be executed and registered in this case . if yes , what is the stamp duty .
2. will the family settlement deed be valid?
3. can the parties get their share of land mutated in the revenue records on the basis of the family settlement .
4. will there be any problem in getting the lands mutated in their name on the basis of family settlement .
respected members kindly help . thanks
How to deal with builder
Dear Sirs,
I have booked an office in a commercial building before construction began in April 2010 and the builder has asked me to pay 50% of the total amount as advance payment for my booking and the balance is supposed to be paid by me in installment according to the progress of the work , Today after 20 months the builder has decided to turn the commercial building into residential (for his own benefit) he has offered to either pay more and buy a flat or else he will return the money with 1% interest within 3- 4 months , since i don't have a budget to buy the flat , i am forced to accept the second offer of taking the money with 1% interest but considering the money has been lying with him for 20 months , also now with the same amount of money if i want to book a fresh office in the same area i will be unable to , as the price has risen by 1/3rd of what it was in April 2010.
Is there any way to reduce my loss in this matter i.e is it possible to take him to court with only the allotment letter of the aforementioned office?
