I filed a case of NI -138 against the issuer of the cheque, but could not prove a legally enforceable debt, hence my case was declined and the opponent was given a benefit of doubt.
Now the opponent filed a suit for damages due to malicious prosecution.
In cross examination, he said that he had to face a loss of Rs.300000/-because his license as contractor with CPWD could not be renewed as he became late in applying for renewal, being busy in attending court dates in the NI-138 case filed by me.But he has no documents to prove his claim.
So should we call CPWD to prove him wrong(we know through an RTI reply that he never applied for license renewal)or should we not, because it is his duty to prove his claim ???
What if we call none as witness to prove him wrong, would that go against us??
Please guide me.

Dear All,
I am an American Buddhist monk currently meditating in the Himalaya. Our Sangha is considering to establish a Public Charitable Trust in HP and establish a meditation centre for public good.
1.What are the Acts and relevant laws involved ? We went online and it is said that "It may, however, be noted that the Indian Trusts Act does not apply to public trusts which can be formed by any person under general law. Under the Hindu Law, any Hindu can create a Hindu endowment and under the Muslim law, any Muslim can create a public wakf. Public Trusts are essentially of charitable or religious nature, and can be constituted by any person." How should we proceed ?
2. What are the necessary considerations ? We have received inconsistent legal advice from local lawyers who showed us The Indian Trust Act,1882 as guidelines.
3. Can we establish a Public Charitable Trust first with a sum of money and purchase land for the meditation centre afterwards ?
Thank you very much. Looking forward to your advice.
Yours sincerely,
Ratthapala Bhikshu
I have filed a suit for possession in Delhi on bonafide need under 14 D,Delhi Rent Act.
On next date argumentation would be heard by the court.I have given reply to each and every logic given by the opponent and also reasoned out documents produced by him against my claim in my rejoinder.
But Suppose the opponent brings some new documents to prove my claim wrong,on next date, which is scheduled for Argumentation, two question are arising in my mind:---
1) Would those new documents presented by the opponent be considered by the court ?
2) If yes, would I be given time to collect the documentary evidence in reasoning out the fresh documents produced by the opponent ?

Apart from Non- Disclosure Agreement, what other steps should be taken to make sub-contracting safe?
Here, the documents are confidential and the principal oursourcing company wants to oursource it to other company.
The problem is that the principal company cannot hide the name of its client whose work is to be sub- contracted. So what steps should be taken to make the sub- contracting safe so that even if the name of the client is disclosed the project remains safe with the principal company?
