SIR! CAN I SEEK RELIEF IN ANCIPATORY BAIL TO GET SURRENDER IN REMAND COURT?

If you get the anticipatory bail you will have to surrender before the trial court to get a regular bail.

If you want anticipatory bail(bail before arrest) you need not surrendered before the court then you can file an application u/sec.438 cr.P.C. in district or High Court,but if you get bail by the surrender the accused person in trial court then you can surrender but there would have at risk in non-bailable section.

If you surrender before trial court then no question arises of seeking anticipatory bail. Matter in that case remains for regular bail.

If anticipatory bail is granted then terms of bail are to be followed which may include surrendering before lower court.

in UP right of anticipatory bail as well as injunction is not available so lawyers of that state should make a joint representation to restore these provisions similar to rest of the country. Even J & K has provision for anticipatory bail then why not in Uttar Pradesh?
