(Querist) 03 June 2013 This query is : Resolved
sir,
what is the validity period of non-judicial stamp papers in Delhi state.
Although its already cleared by the supreme court of India in his judgement dated 19-02-2008 in the case of Thiruvengada Pillai vs. Navaneethammal and Anr.,i.e. the stamp papers do not have any expiry period.
But it could be according to the Indian Stamp Act 1899.
does it vary from state to state.
Thank You

Dear Mr. Goyal,
Can you please indicate the specific provision according to which the validity in Delhi is 6 months?
pranshul jain (Querist) 04 June 2013
sir, but what about that supreme court judgement. How does it effect the stamp act.
Rajendra K Goyal (Expert) 04 June 2013
Expert Anirudh Sir,
The validity for getting a refund of Stamp paper is six months,Stamp Papers used even 6 months old after its date will be valid. In view of the Supreme Court judgement dated 19/02/2008 , Thiruvengada Pillai Vs. Navaneethammal and Anr.

. "The Indian Stamp Act, 1899 nowhere prescribes any expiry date for use of a stamp paper. Section 54 merely provides that a person possessing a stamp paper for which he has no immediate use (which is not spoiled or rendered unfit or useless), can seek refund of the value thereof by surrendering such stamp paper to the Collector provided it was purchased within the period of six months next preceding the date on which it was so surrendered. The stipulation of the period of six months prescribed in Section 54 is only for the purpose of seeking refund of the value of the unused stamp paper, and not for use of the stamp paper. Section 54 does not require the person who has purchased a stamp paper, to use it within six months. Therefore, there is no impediment for a stamp paper purchased more than six months prior to the proposed date of execution, being used for a document. “

pranshul jain (Querist) 07 June 2013
sir,
one more question arises, the stamp papers that I have all those are impression ed stamp papers, and from last 1 year in Delhi these impression ed papers are replaced by e-stamp papers so, are these old stamp paper can still be used.
thank you
Anirudh (Expert) 07 June 2013
It is an unnecessary query. So long as the stamp papers purchased by you are genuine and valid (whether embossed stamp papers or e-stamp papers) there is no limitation as to their validity.
pranshul jain (Querist) 07 June 2013
thank you sir.
