(Querist) 15 January 2014 This query is : Resolved
Dear Sirs,
My case of 125 crpc is stayed by high court saying that-
"Till the next listing, further the proceeding of this case will remain stayed."
Sirs,
what does it mean? If i get listed my case in high court then my stay will be vacated and i can start my proceeding in lower court. Please advise me. Thank you.

Raj Kumar Makkad (Expert) 17 January 2014
Stay order shall automatically get extended until it is vacated. Wait for the final outcome of high court case.
Advocate. Arunagiri (Expert) 17 January 2014
Many times the cases are not listed as per the schedule. So the court will order for stay till the next hearing.

Only on the next hearing the court will decide whether to continue the stay or to vacate it.

I agree with experts.
