Dear sir, If 498a case is withdrawn by wife in trial court by compromise deed by paying permanent alimony and then here itself the case can be closed without any problems again in future on me and on my family members or I need to go for quash in High court with compromise deed. Thanking you
adv. rajeev ( rajoo ) (Expert) 19 December 2018
When it is compromised then you need not go to high court for quashing

Pls don’t post as AQ and post with your ID and you can get many responses.
Your ID does not mean your email id or phone number etc and don’t post these.
Before attaching any document erase all names, logo, email id, phone number, address etc to maintain confidentiality.
Obtain proper legal opinion in writing from LOCAL counsel specializing in concerned field of law.

better go for quashing...withdrawal of complaint is a complex issue, things depend upon allegations, stage of trial etc.
Dr J C Vashista (Expert) 20 December 2018
Whether any FIR was registered for the case u/s 498A IPC ? If so, get it quashed on the basis of compromise arrived between the complainant and respondent/ accused. However, if the case was registered through an application/complaint u/s 200 Cr PC and the case is compromised it need not be quashed but withdrawal by complainant in the Trial Court.
What is your locus standie to the academic and hypothetical question ?
An anonymous author should not expect obligation of experts as per rule of this platform.

I totally agree with Dr. Vashista.. nothing more to add
