Redevelopment

(Querist) 20 January 2012 This query is : Resolved 
In a general meeting of the society, we propose to take consent of of members for the redevelopment of the buildings.

What procedure should we follow ?
consent of atleast 75% is sufficient?
To pass a resolution what should be the content of resolution? request to provide draft.
Any other imp. and material requirments and suggestions are solicited.

the bye laws lay down detail procedure for redevelopment .obtain consent of members in AGM . appoint a consultant /architect . float tenders . shortlist bidders . place it before AGM for decision . get it approved by Registrar

You have to refer the bylaws of your society.
Each society has their own bylaws.

All aspects of the redevelopment like builder, its terms and conditions, procedure to make timely payment, procedure of re-allotment, alternate residential provisions, re-developed facilities, time to be consumed etc.

I presume that you are from Maharashtra.If so, You will have to follow the procedure prescribed by the Maharashtra Govt in their circular dt. 03-01-2009. Better acquaint yourself with all other formalities. Take advice of an Advocate who is handling such matters, so that you pass proper resolutions and comply with the requirements of the circular referred above. Hope all MC members of your Scoiety have filed the indemnity bonds soon after assuming charge of Office, as required by Sec. 73(1A) of the MCS Act.
