Public nuisance

(Querist) 01 February 2021 This query is : Resolved
Children playing in our flat are always shouting and creating nuisance during playing. Already informed them several times but they and their parents are not listening. Any suggestion to solve this. We have children studying for their exam, employees attending meeting and old people.

Instead of being rough and hard with them your Kind request would make them obey. Children's noise is a subject to special principle of tolerance from society. The noise of playing children is an expression of child development and blossoming therefore has to be tolerated
Ramesh T (Querist) 01 February 2021
The problem is also with their parents. They are purposefully asking their children to do so to prove themselves that they have full rights in the flat. Is there any way where I can just threaten them. Please advice.
Guest (Expert) 01 February 2021
If that is the case only the Police could be approached to warn their parents
Ramesh T (Querist) 01 February 2021
Thank you Sir for your advice. I will first inform the society with a formal message and then proceed further

Refer Sec 268 IPC --Public Nuisance
Sudhir Kumar, Advocate (Expert) 01 February 2021
Based on given facts the views expressed by Mr NKS Rajkumar are correct and appropriate.

However, you have stated that the parents of the children are making a point that the children should play there. This gives a strong doubt that some water has already flown. You have be bear in mind :-

(i) None in the locality will.
(ii) In most possibility police may not take any action.

Settle matter amicably by talking to parents of said children.
Advocate Bhartesh goyal (Expert) 02 February 2021
Yes, settled the matter amicably by talking to office bearer's of society and parents of children.
Rajendra K Goyal (Expert) 02 February 2021
Agree with the advice from expert Advocate Bhartesh goyal, R.K. Nanda.
Dr J C Vashista (Expert) 03 February 2021
I endorse experts advise for amicable settlement.
However, the children are stated to be playing with lot of noise in your flat which is with your consent, then what is the problem ????
