This query is : Resolved
I am searching for a 1 BHK rented property at Janakpuri, New Delhi. Last Sunday i.e. on 01.06.2014, I met a property dealer there. He showed the property and I said OK; the property is fine for me.He told that the monthly rent will be Rs. 10500 and registered rent agreement will have to be made. Also, he asked me to pay Rs. 5000 to the owner of the property.I then paid Rs. 5000 as an advance for the security money and paid Rs. 3000 to the property dealer for registered rent agreement. He has also taken Rs. 3000 from the owner. Owner gave him Rs. 3000 out of total 5000 Rs. which I had paid to him.
Suddenly, I have been asked by company to join at Angul, Odisha site for one year. Then, I contacted the property dealer.
But, he is saying that he has already processed for registered rent agreement. He told that he has submitted the fee and now, there is a long procedure to get the cancellation.
Interesting thing is that he has not collected any of our documents for registration.
He also told that Court at Basai Darapur, New Delhi will send us a date through sms. On that date, both the parties will have to remain present before the court for registry.
I want to know what is the actual registration fee for this rent agreement including all the fee i.e court fee etc.
since, I have paid all the money in cash. How can I get my money back?
Please guide me.
Thanks,
Gopal

Do not worry, if you do not remain present on the scheduled date, if any, the registration will not happen.
However you will have to loose the brokerage money for sure but you may try to recover the balance security money.

I agree with Mr. Devajyoti Barman, the agreement cannot be registered in your absence and forget brokerage.
Request the landlord to refund advance, if not full, after deduction of a part of it.
However, you will have to spend much more in litigation then what you will gain in adopting legal course to recover the money, which is again indefinite that whether you will loose or win.

Better forget the amount spent as recovering it through legal process would be more costly money wise and time wise.
In your absence no registration can be done.
Send registered letter to land lord that you have been transferred and not interested in taking the room on rent so refund the advance of Rs. 5,000/- given to him.

actual registration fee only local lawyer can guide you . chances of recovery of Rs 8000 are bleak . broker will not refund his brokerage amount . going to court for recovery of advance money of rs 5000 is not worth it .

There is no use to agitate against such palty amount especially in Delhi wherein the fee of the lawyers is may times more than your actual loss incurred.

I agree with the experts opinions that recovery of brokerage and other small amount through legal process is a futile exercise, instead talk to those people and settle the issues by getting whatever you can extract.

Thanks to all for your valuable responses. As per your advice, I had requested to the landlord and he returned me the advance rent.

brokerage is their reightful money charged. As you cancelled yourself; you will loose . For documentation, it is gone money. For registration, the amount you will spent to recover will be more than what u get; unless you personally go pillar to post wasting your dozens of days..
So FORGET..
