Pl. help get laws governing identity of a citizen

It will be nice if laws governing identity of a person is made known. This is with specific reference to: Address, Change in address, Processes to get registered in old place, new place; Prescribed residency period (Time limit) etc allied aspects

Main Fact:
The Rajya Sabha Members too need be governed by Rules that govern identity. They cannot jump state successively just to get into RS & is thus a fit matter for Official action & if not, Judicial intervention too. Complaint can be raised with authorities. Thus, it be please noted that this is purely a public cause.

Following is humbly submitted:

QUERY: "The form for RS membership has a column Address. What Rule/s governs that column?"


BACKGROUND: RS Members have filed one address 5 years ago, have changed it at the end of that term & have now filed another address in another state.


Citizens are not given identity card, etc in this way. One can shift residence. But, registrations etc are possible only after minimum residency period.


Thus, it is imperative to understand pertinent rules.

Hon'ble Members,

At the outset, thank you for your valuable time.


THE ISSUE IS:
LS/RS Members have furnished Address-1 (State-X) in 2010/11 & now, in 2016 have furnished Address-2 (State-2).


But, this is not the way it works for citizens. One can change address. But, registrations are done only after minimum residency period & the change is done as per a process. - Thus, it will be nice if the Members discuss on the Rules that govern change in address, process to get new identity card & other allied aspects.


The big parties have themselves done this injustice. So, the authorities need be approached.

It is pertinent to keep you posted that the suggestion to search Google is being followed. So far, it has come up with following:

1. Form 8A is required to change address.
2. Conditions on which address change is normally accepted for normal Indian citizens:
a. After marriage.
b. Completely transferred to new location.

Am sure the homework is not enough to face doyens. Thus, undersigned will be able to take on these sorts of questions only after thorough work. But, time is running out, resources are scarce & there are plenty of practical difficulties.

Four new Rajya Sabha members take oath

M J Akbar of the BJP, Oscar Fernandes and Jairam Ramesh of the Congress and Satish Chandra Misra of the BSP on Friday took oath as new members of the Rajya Sabha.

The four members, who were re-elected to the Rajya Sabha in the recent biennial elections, made and subscribed to oath, which was administered by Rajya Sabha chairman Hamid Ansari.

While Fernandes and Ramesh have been elected to the Upper House from Karnataka, veteran journalist Akbar has been elected from Madhya Pradesh and Misra from Uttar Pradesh.

Among those present at the function, held at the residence of Chairman of the Rajya Sabha, were Rajya Sabha Deputy Chairman P J Kurien, Leader of the House in the Rajya Sabha Arun Jaitley, Parliamentary Affairs Minister Ananth Kumar and Ministers of state for Parliamentary Affairs Mukhtar Abbas Naqvi and S S Ahluwalia.

THE ISSUE:
One of these member's had furnished address as State-1 from 2011 to April/May 2016 & in May/June 2016, this same member has refiled nomination & has furnished a new address, from State-2. The big party has got the member re-selected, but from State-2.


This is objectionable. Corruption never dies.


PLEASE HELP REACH A COMPLAINT WITHIN THE LIMITATION PERIOD TO THE AUTHORITY TO REVIEW THE DECISION. (Corruption will never die if nothing is done even at this critical stage. India has number of competent aspirants. New blood can get rid off the defective system & the ills that are bothering the nation. But we are going to lose more due to this selection / induction. This SHOULD END. SHOULD END). Pl. show understanding & help the cause.

Hon'ble Members,
Initial homework suggests that the task is quiet big, the Rule 3 of the RP Act need be challenged.


Entry into LS needs a member to be from that constituency. But for entry into RS it is not so, the member could be registered anywhere. The rule is reproduced below:


Part-II (Qualifications & Disqualifications): Rule 3, RP Act:
Qualification for membership of the Council of States.
—A person shall not be qualified to be chosen as a representative of any State or Union territory in the Council of States unless he is an elector for a Parliamentary constituency [in India].]



OH! WHAT A BIG MISTAKE. This mistake is costing the Nation enormously. (I am sure you have all viewed the thread in which I have posted the News Item from the Times of India that pertains many crores for the MLAs' vote (as per the common command). The same thing has been happening on & on. Science, management etc need add value to Indianness. But, corruption are changing the very precepts itself. Everything is getting corroded, eaten up; everything, entire nature, all animals, values, morality etc etc).


Your advice is now sought in the wake of the this homework. Even LS terms need be modified & residency period etc need be introduced.


It is pertinent to note that help is not being sought for any exam or for any personal use & it is a public cause, a devotion to remove corruption right from the root well upto the topmost. Let me assure you that everyone will definitely cherish your contributions someday. It will be nice if you could help the cause.
