My father is having a flat in society at goregaon East. As my parents are old now so I am parking my car for them in their premises from last 3 years and my 6yr. old daughter also stays with them we are also there many times.
But 2 days before suddenely manager asked for RC book which we gave him then they told us to vacate the parking lot saying that the car is not owned by my father.
Actually this is kind of harrashment happening to my father there are some more payment issues like extra transfer charges have been taken by society i.e. 100000 for which my father is fighting with them on the same.
so they have been started harrashing him by making new new things.
many people are having complaints against committee but 2-3 members are like gunda kind person.
so no one wants to go ahead.
kindly advice me in this parking matter as per my knowledge its written in model byelaws that A member having car is eligible to get parking but it dosent mean that it should be owned by him. now he is 63 cant even drive.

The Managing Committee or the Office bearers have no authority to peep into family affairs or arrangements.

Sale agreement for the flat and the allotted parking lot will be between the developer and your father and legal heirs.Also persons as allowed by your father can reside with him or use the car parking place.
I agree with Expert Mr.P.Venu's answer.
Now-a-days Local Police station that has jurisdiction,renders services on complaints not only criminal cases but also to bring harmonious living in high rise buildings.
Lodge a complaint in writing get it numbered under "Social Service" category.
I took this route in my personal case and got it solved.

Bye law 3(xxv)of the model bye laws defines "Family"to mean,inter alia, son, daughter etc. As such the querist can take a stand that being member of the family, he is entitled to park the car in the Society's compound. But the society may contend that as he does not stay with his parents, he should not park his car in the Society's compound. he should avail the facility in the Society where he is staying. This argument of the Society may sound reasonable as the common places in the Society should be available to the members and their family members who are staying in the Society.

If no specific parking lot is sold to your father and if you are parking the car common parking lot the problem as expressed by Expert M.V. Gupta is bound to occur.
In our complex an owner used to take his friend who visits him sometime to gymnasium.There was no murmur about it from Association for sometime.But one fine morning the security in the gymnasium told the owner that his friend will not be allowed hence forth and he is acting on order from Secretary of Association to allow residents only.
