sir,
i have sent a legal notice on dated 23.03.2011 through registered post but without acknowledgement, that notice not returned back in that case please tell me time period to file complaint validaly.

If the notice was not returned undelivered, it can be legally presumed that the Registered Post is delivered.

To avoid the risk you should calculate 45 days from the date of notice [15 days of notice and 30 days after expiry of notice]. But you need to get a certificate of delivery from post deptt.

Better get a certificate of delivery from the boking post office, which on payment of nominal fee will get information from the delvery post office and intimate you in due course. That would be a erfect proof of delivery.

what is written on the returned postal cover? It is important. Some times while sorting acknowledgements will be disappeared because of the negligence of the postal employees.
You can do one thing, lodge the complaint before the superintendent of post office and ask the details whether the regd., notice sent on so and so date is delivered or not. From the date of receipt of answer you will get the cause of action to file the complaint.

Dear Mr. Aravind,

You have sent the notice through registered post on 23/3/11,if the recepient has not taken the notice then it should have come back to you by now.Enquire in the post office from where you have sent the notice and as per the directions of your lawyer proceed further legally without wasting further time

You can obtain certificate of delivery from the post office from where u sent the registered cover. you have to give an application to the post master for the above purpose. In ur applicatin u have to provide the registration receipt no. and date of booking the regd. cover. No fee is payable.The certificate will be an admissible evidence in the court to prove that the notice has been received by the addressee.
