Manpower supply

(Querist) 11 October 2013 This query is : Resolved 
My friend is going to start Manpower Supply services in Properietorship / Partnership Firm. At present he has 15 persons. My query is if he needs any registration & if yes, with which authority. I feel that EPF, ESI & Contract Labour (R&A) Act are not applicable due to low number of persons. Also Service Tax is exempt upto service of Rs 10 Lacs. Please share your valuable views & correct me if I am wrong. Thanx

ESI liability is applicable upon him as the number of employees has already crossed 10. Your friend needs to get registration with Labour-cum Conciliation Officer of his area. Sales tax depends upon his turn over.

You can contact Local Lawyer to do Registration in the Labour Office relating to their employees and ESI, PF

even if his employee may be less than 20 but the companies which are going to hire his manpower may have aggregate of 20 including your labout. So PF liability will still be there.

Thanx for the views. I think this is the new angle, which we should look at. Is it really to be interpreted like that i.e. strength of manpower of the company (whom supplied) is to be seen rather than of the supplier ?
