Maintentance charges for ownership flat

Dear sir,

what is the criteria for charging maintenance of monthly for all flats in ownership building society. (1)equal to all flats or (2) as per sq.ft. area of each flats.

depends on bye laws of society.

It could be a mix of both and as said by expert Mr.Nanda it depends on bye laws of the society.

As decided by the General Body of the Society which has to be consonant with the Bye-Law/Rules/Act applicable on the subject.

Prima facie it is an academic query, otherwise consult a local lawyer.

In Maharashtra, as per the available Model Bye-Laws AND as per a Mumbai HC judgment, the Society Maintenance charges have to be charged as per "per Flat /Unit" basis and NOT as per "per square feet" basis.
