Maintenance charges area wise or unit wise

Hello,

I have come across several judgements confirming that society cannot charge maintenance charges according to area of the units and have to charge equal maintenance charges per unit. Is this also applicable to housing societies only or commercial complexes also ?

It is levied in accordance with the requirement, exigencies in the area as prescribed in its bylaws.It is the prorogation of the cost effectiveness involved.

The maintenance charges are levied on all the flats as per Bye-laws of the Society or your case is singled out ?
