hello sir i am pooja agrawal semi qualified ca .sir a person who steals the things in are shop police has taken actions and recover the some cash and things from him and now a case is pending in the court. but now he is imposing total fake cases through application in court in the name of my father, brother and uncle please suggest me what should i do to stop him .

As the first case is filed by Police (as I could understand from your post), take the assistance of police, who can warn him if the cases are really fake. However, if he is bent upon, you will have to engage a lawyer who can prevent the cases at admission stage. There is no such formula that one can stop legal action contemplated by the other.

Referring theft case pending in the court awaiting trial you can file a criminal case against the accused u/s.211 IPC for malicious prosecution. The term 'malice' here is to be considered as 'malus animus' and shall be denoting that the accused is actuated by improper and indirect motives and with the intent to cause injury to the complainant.
