Grand-son's property claim on maternal grand-father's property

(Querist) 04 November 2013 This query is : Resolved
Can any grand son claim on his maternal grand-father's property ??
Where as grand-father was died without making his will, and left the property on behind of 3 son & 4 daughter, and eventually all 4 daughter were passed away.
Now maternal uncles have already make the property paper(not will) to plan to sell the property.

1. No, as your grand-father (maternal i.e., nana ji) was died without making his will.
2. Since his sons (your mama ji)are class 1 heir of your grandfather the property shall devolve upon them and they are well within their right to dispose it off.

The grandson has a share in the property through his late mother.

The property would be divided among widow of the deceased, all the sons and daughters of the deceased equally. You can inherit share from your mother.

If a male hindu dies without making any will, his property devolves on his wife, mother, all sons, all daughters in equal share. Son and daughter includes predeceased(died before the death of hindu male) son and predeceased daughter. All of them are class I heir.Position of law cannot be changed by any office whatsoever. So be happy and fight for your rights.

The process can be challenged by your mother.

Grand pa's wife and daughters were passed away earlier, and grand pa also died without the will.
All my maternal uncle make the Paper from BLR office stating that they are the only owner of this property. And also chat with a broker to deal the property. Can we challenge the BLR office Govt. to prove the Paper wrong and force them ( BLR officers) them to make new paper with all daughter name?

Dear Kaustubh,

In the property matter, you have to indicate the following:

1. When did your maternal grand father die?
2. How did he get the property in his hands?
3. You also have to state whether your grandmother was alive when your grand father died.
4. When did your mother and her sisters die?
Only after knowing this, one will be in a position to give an answer to your query.
