Fir booked against my brother

sir i am vinod my brother got central government job.But the problem was fir booked against my brother in family quarrel. My grand mother booked the case against my brother. sir is there any problem for my brother future. kindly reply how to face police enquiry. please send reply soon plz plz plz plz plz plz.............

Any body can lodge complaint against a person. It doesn't mean that the complaint is true and the offence has been committed as alleged in the complaint.

On the other hand, the police (Investigation agency) has to investigate the matter to find out the truth and file their investigation report before the court.

Your brother also can establish his innocent even before the police if such circumstances is warranted. However, ultimately, the Court is the competent forum to decide whether any offence is proved or not?

The mere filing of complaint and registering FIR thereon are not a ground to arrest a person unless and until it is satisfied by the Investigation agency that the commission offence is true.

Since FIR is registered by the police against your brother, it is advisable to get either anticipatory or regular bail as the case may be, from Court for safer side.

He should cooperate in the investigation.

Consult a local lawyer and show him all the documents and get his advise on the basis of these documents.

If there is any column in the service form about pending court cases. state facts if case goes in court till that date.

You should not hide the lodging of FIR at any cost. Every offence do not come within moral turpitude and thus the appointing authority shall decide the issue. You should tell truth to the enquiring police official

FIR WAS BOOKED AGAINST MY BROTHER IN FAMILY QUARRELS. MY GRAND MOTHER BOOKED THE CASE AGAINST HIM. MY BROTHER GOT BAIL. BUT RECENTLY HE GOT CENTRAL GOVERNMENT JOB, IS THERE ANY PROBLEM WITH POLICE CASE AND TELL HOW TO FACE THE POLICE ENQUIRY. PLZ SEND THE SOLUTION TO MY PROBLEM. PLZ PLZ SIR....

By just registering a FIR, the accused cannot be held guilty of the offence, let the case come to the court, engage a lawyer and challenge the issue on merits and get acquitted.
