Q) can supreme court force husband to live with her wife? justice order both the parties to appear before court on 29/07/13. earlier mediation has failed in supreme court. i afraid that my wife will try to get sympathy of the court and get transfer petiton of my divorce case allowed in her favour.moreover what shd be my approach in the court?

No Court can force any party to marriage to live togather against their wishes yet the truth is that law cast on them a duty to try for to make them agree to live togather.

Husband and wife cannot be forced to live together. The court makes the efforts of reconciliation, however, the decision to live together or not is entirely upon both the parties.

sheikh sir i am from jammu j&k. i know that my wifl not come back but she is doing legal tactics to fetch maximum alimony. and also get tranfer petiton allowed to her native place in punjab.

Q)archana mam what happen if i clearly refuse for reconcilation in front of justice of s.c. does T.P is allowed in favour of my wife or it is decided on facts and merits? my wife is very cunning and try to get emotional by falling false tears in front of justice to get T.P in her favour

Transfer petition will be decided on facts and merit. If it is really very inconvinient for your wife to attend the place where the divorce petition is pending, the court may transfer it.

you have to adopt a constructive approach . when you appear before the SC mention that you wanted a reconcilation but your wife is adamant . if it is not possible to stay together you can take a plea that you are willing for divorce by mutual consent too . transfer petition is generally allowed . convenience of wife is taken into account
