False statement in registrar office

(Querist) 21 September 2016 This query is : Resolved
Dear Experts,

A person got a deed registered in Sub-Registrar office. This deed is regarding a correction deed in his residential sale deed.
I have knowledge that he gave some false statement to get this deed registered with Sub-registrar to fulfill his illegal aim.
Now, I want to know that as a citizen not directly involved with this, can i report this crime to Police?

Advocate Kappil Cchandna (Expert) 21 September 2016

Make a complaint under Sec.81 and 82 of Registration Act, to the Registrar who registered the said document that the document is a forged one/false statement with proof. The the Sub Registrar after getting permission from his higher authority to launch prosecution if he finds any false/forged document.

What false statement has been mentioned in the deed and how it affects general public or law of land?

Explain first.

Sometimes, even without waiting for clarification, if sought by anyone from the author, some of us jump to answer query without knowing background of the case, irrespective of whether that serves any purpose of the author or adversely affects him.

Satyanarayana ji,

Would you please like to make a review of your reply with particular reference to the proposed section 81 and to whom that applies?

Ms.Usha Kapoor (Expert) 22 September 2016
File a complaint under Section 81 and 82 OF REGISTRATION act And THE SUB REGISTRAR AFTER GETTING PERMISSION FROM registrar WILL LAUNCH PROSECUTION IF ANY FALSE OR FORGED DOCUMENT IS FOUND.8Refisrar willl launch PROSECUTIUON AGAINST THe OFFENDER.
Raj Kumar Makkad (Expert) 22 September 2016
Not only Satyanarayana ji but some other experts are also going on the same track without knowing the destination.
Guest (Expert) 22 September 2016
In my opinion, Sec.81 is not relevant in this case. I hope both Shri KAVK Satyanarayana and Ms. Usha Kapoor would like to review their replies.

Makkad ji,

I strongly endorse your observation, as if the experts have to take part in some race, may their views affect the querist adversely or themselves prove to be a tool for solution to academic queries of law students to help creat an army of lawyers without appropriate knowledge of law out of easy going students, who don't like to concentrate on their course modules and aspire for 100% spoon feeding from the experts.

The irony is, they don't think over the possibility of losing their own image, if they go wrong in suggesting a solution, merely on the basis of their guess. They also don't give any thought over why some of the experts have raised some questions over the deficient or false description of the querist. If they give proper thought over that, they can very well know that they have been helped to extract the real facts of the case, based on which they can advise rightly, instead of going wrong to lose their immage.

Anyway, it is their own way of thinking!

So what was the purpose of posting the query!
pramod (Querist) 27 September 2016
Dear Experts, i regret late reply and here are the answers to ur queries....

What type of wrong statement / false statement was given?

Actually after 7 year of Registration of a Sale Deed, the Buyer executed a Correction Deed to correct the name of her husband & her residential address stating that it was wrongly entered in Sale Deed.
It is a False Statement as even stamp papers were purchased by Buyer indicating the name of her husband as in the Sale deed and even the Home Loan from a Bank was availed jointly by them.

How it is material?

It is material as it was done to get unjustified gain in a court matter.

Whether it amounted to some fraudulent activity?

Yes it seems a fraud as if a lady buyer bought stamps papers stating her husband's name as X and even availed joint home loan with X as husband-wife, then why she gave false statement in Registration Office stating that by mistake she mentioned Mr. X as her husband just to delete the name X as husband.
Rajendra K Goyal (Expert) 27 September 2016
Husband can proceed to cancel the amendment deed if executed.
Raj Kumar Makkad (Expert) 27 September 2016
As the sale-deed is executed by seller hence the correction can also be got effected by him only and not by the buyer.

Better to avail the legal advice of local lawyer by showing him your documents.
Kumar Doab (Expert) 27 September 2016
Why don't you relate it with photo ID proof annexed!

After all this should be the basis!
isn't it?
