Sir, applicant have filed a forged evidence in a regular civil suit 2008. It was decreed in 2010. This case is appealed in district court, but no use. Now second appeal is applied in high court.
Meanwhile we are trying to apply under cr p c 340 a application to civil court, original court where the forged evidence received.
Is there is any limitation period applicable for this cr pc 340 application? I mean is it in within limitation period?
The offences amounting of the forged evidence are of IPC 193, 167, 168, 171, 34 etc amounting offences of sentence more than 7 years.
Please suggest.

Sir, the plantiff submitted forged document evidnce in CJJD court and he won the suit. It was a prime evidence for the case. Then we appealed in district court as first appeal but order is same. The order is stayed for another week as we are moving to second appeal.
Meanwhile we have discovered a forgery in a evidence now. So we are thinking to file complaint, so what is the procedure?
1) to which court CJJD or District court or HIGH Court?
2) Just complaint or petition under crpc 340?
3) Affidavit is required or not?
Forged document is Form 8 of a house signed by Gramsevak. He has done forgery in house no column.
Pls giude.
