Ground floor room extended & building comm premises captured

Dear Experts,
In Mumbai based coop society G+3,50+ yrs old society, one ground floor room arrogant member illegally extended/constructed unauthorized construction or encroachment his flat 6 feet ahead of his balcony & beyond structure of building more than 25 years back & common space premises in front of his flat is also captured by installing fencing & not allowing members to use/enter common building premise. Even small childrens not allowed to play in captured common premises, they fight with parents

for this unauthorized construction or encroachment
what action society or other members can take against this member ?
how much fine/charges can be levied on extended structure ? rs.5000 or maintenance * 5 times per month
can additional charges/fine on fencing also be charged other than encroachment ?
if society want to demolish that 6 feet additional construction, what is remedy ?
where can members make complaint other than society ? like BMC/police/registrar ?

New election procedure 1st november 2018 gr

for Mumbai based housing society (40+ years old mhada bldg) -
what is the New Election Procedure according to 1st November 2018 GR.

any permission or information needs to be taken from deputy registrar before election ?
or just take meeting & select committee member & office bearers ?
any kind of dy.registrar's involvement required ?
anything to consider from I, J, O registers

I am member & given responsibility by few member including committee as they are not aware & asking me to find out procedure.

Action against treasurer

Mumbai-conveyed society -
After AGM successfully taken, secretary & chairman left office. but treasurer took office key, AGM register, chequebook, etc with him & now refused to give back & refuse to cooperate. Treasurer does unnecessary arguments & disputes almost with max. members.
what action committee can take against treasurer to get back official things and if possible remove him from committee?

Co-opt ing members

Co-Opt ing 2 nos. members from within committee members is must or outside committee members can also opted ? or is it possible interchanging office bearer position between chairman/secretary/treaserer ?
if yes then in committee meeting or in AGM/SGM ?

101 recovery

Dear Experts,

1. 101 Recovery - 3 nos. notice is must ? all 3 notices on society letterhead or on legal advocate letterhead ? or only 3rd notice by legal
2.pass resolution before 1st notice or before 3rd notice
3. Inform / approach Dy.Registrar in 1st notice or after 3rd notice ? Kindly give draft format for 101 Recovery in Coop Hsg Soc

Agm report submission to dy.registrar within how many days

Dear Experts,

Within how many days/months MC committee has to submit AGM report after AGM ? for example if AGM was held on 30/09/2017 then what is last date to submit report to Dy.Registrar ?

Can member (who rented out flat) become secretary of society

Dear Sir,

In August 2017 as per procedure State Cooperation Election Authority officers took elections in our Society of 20 Members in Mumbai. 9 members selected & MC Committee also selected by Election Officer. Election Officer declared & submitted the official report.
One member complained that selected Secretary (rented out flat long time back & before 2016.) so he cannot become Secretary.
Sir, please guide on this
1) Can such member become Secretary. If YES/NO - pls give any bye-laws reference
2) Can that Secretary become normal MC Member & make other MC member as secretary within society meeting or election officer again required ?

Wrong or incomplete caste mentioned in school leaving certificate

hello sir
one of my friends daughter's admission form in primary school (in 2005) & submitted along-with his caste certificate, he has mentioned his caste Hindu & subcaste-Mahar but school wrote only Hindu & not sub caste caste in school GRegister. ( I had visited few days back to school with friend & saw in admission form & it is very much clearly mentioned the caste,
His daughter passed 10th this year 2016 but in school leaving, school mentioned only Hindu & not caste & thats why nobody asked for anybody's caste certificate. now school not ready to change it even after showing her caste certificate.
what is options available to get it corrected.
school leaving is not yet collected from school cause they refuse to mention caste.
I told them it is nothing to do with students caste certificate & 1st school have to mention caste in bonafied certificate which is required to apply for caste cert.

Vacant flat two legal heirs

Hello Sir,

Residing in CHS at Mumbai (not conveyed CHS).
One person died in 2012-2013 at age 62 with no nomination & relatives behind (no relatives found visited at all). He was tenant since 30-40 years.

Two people are claiming flat,
1) Says his relative brother
2) Says claims money taken by dicease member & claims flat as well

this two members r fighting & locking the flat by breaking one & putting own.

1st claimer's friend started carrying out internal repair & renovation by breaking bricks.

MC oppose but 1st person did not stop work & he occupied it & not coming out.

MC want to have custody of flat & want to block unwanted people from entering & occupying flat, cause with them some gunda type of people r also coming.

When approch police, they said police cannot make anyone to vacate the flat.

Society members are afraid of thing happening in Society.

Please guide us with solution for MC to take flat under Society's custody & lock & block any such people.
