ESI is an organisation set up by Act of the Parliament, it is a central subject.

As Mr. Vishal said, it is a creature established under a central Act. The following excerpts from their official website may throw light on the working of the Corporation:

Constitution of Corporation

This apex body is constituted and notified by the Central Government for a four year term and represents various interest groups comprising employees, employers, the Central and State Governments besides the parliament and medical profession. Union Minister of Labour functions as the Chairman of the Corporation whereas, Director General ESIC, is also an ex-officio member of the Corporation.
