Privileged Leave

(Querist) 27 August 2008 This query is : Resolved 
A factory had declared 17 days leave as Diwali Vacation in the year 2007. Can it adjust this against the privileged leave available to the employees. If yes, then whetehr any consent from the employee / labour inspector is requried in this regard ?

The holidays, voluntarily declared by the management on Deepawali festival season can not be adjusted against PL in the absence of an agreemnt to this effect with Trade Union/ Association of employees or with the representatives of workmen in this regard.

Whether it would be legal to obtain the written consent of all employees and carry out the same.
