Procedure in Metropolitan Magistrate Kolkata

Hello Kolkata Advocate Friends

One of client received summons from Metropolitan Magistrate Court at Kolkata under Negotiable Instruments Act. Can any one please help me with the procedure and necessary petitions to be filed to defend the case.

1) What kind of memo need to be file or vakalath to be filed?

2) I am a practising advocate in chennai can i appear before the said court or i need to engage the concerned bar persons alone

3) any special rules or regulations to be adhere to defend the case in such court

1. No memo need to be filed in Kolkata courts. Once the advocate appears he can only file vocalatnama and if on the same date the bail is prayed for then the accused person is also required to be present or on the next date.
2.Being a lawyer you know that an advocate of any Bar can appear in any court in India including Supreme Court(with AoR). However as the distance pose a major hindrance we prefer to engae a local lawyer.
3.No special regulations or rules are there except typical local preactices.

N.I.ACT IS A CENTRAL ACT AND PROCEDURE IS SAME FOR ALL COURTS .YOU FILE A VAKALATNAME AND APPEAR WITH ACCUSED AND SURETY AND DEFEND THE MATTER AS YOU DEFEND AT YOUR PLACE.

You can appear.Try to collect informations from a lawyer of MM Court, then it will quite easy for you .
