Neglected child custody

My child is totally neglected by his mother, as her mother is totally neglected him by not giving proper food, education, allow to meet with family members. Her mother is a characterless lady living in immoral life.

I want to properly investigate my claim under The Children Act 1960 & take child in my custody u/s 16 of the act.

Where should I lodge complain ?

I never heard of it, as this Act is in force in India?

Yes it is Indian act.

Yes. It is in India also. You may go through Sec.4 of the Act and consult a local lawyer in the matter.

Section 2(l) of the Children Act, 1960 defines "neglected child" as a child who-

(i) is found begging; or

(ii) is found without having any home or settled place of abode or any ostensible means of subsistence or is found destitute, whether he is an orphan or not; or

(iii) has a parent or guardian who is unfit [or unable] to exercise or does not exercise proper care and control over the child; or

(iv) lives in a brothel or with a prostitute or frequently goes to any place used for the purpose of prostitution, or is found to associate with any prostitute or any other person who leads an immoral, drunken or depraved life;

Whether your child is indulged / involved in either of the above ?

Simply file suit under guardianship and wards act. Pray for guardianship for the interest of child. Evidence needs to be stronger that your child is neglected.
