Police verification

(Querist) 27 February 2018 This query is : Resolved
would like to bring your notice that I did have credit card unfortunately I lost my job and I was unable to make payment on that time but as of now I made settlement with the bank and made payment on banks terms and condition and eating for NOC. Furthermore i selected of sub inspector in police, my verification is about to come. Does it affect my police verification? Moreover when I checked my CIBIL I get to know that "suit filed and written off" is written in my civil report, what does that mean as well as does it affect my police verification.
Vijay Raj Mahajan (Expert) 27 February 2018
No. Even if civil suit for recovery was filled and written off that is not criminal proceeding.
Kumar Doab (Expert) 27 February 2018
In matter posted by you IT is felt that there is nothing for police to report in police verification for said purpose in your query.
Kumar Doab (Expert) 27 February 2018
Was any suit indeed filed in court?
Did you get any notice/summons?
The CC company might have sent by ordinary post notice to attend ‘arbitration Camp’, ‘Special Lok Adalat’ etc and might have inserted suit filed.
You can ask for copy of credit report from CC company without any cost or nominal cost as per RBI guidelines say;Rs.50/-
RBI guidelines are available on RBI website.
Contest the said suit filed with CC company and ask to supply the details.
Settlement is adverse entry and amount claimed as per CC company was not paid hence balance is posted as written off.
The employee should not be insolvent.
If it was duly negotiated by you and reduced in writing or assured to you that CC company shall cleans the credit history and call back name from list of defaulters then ask the CC company to change/correct the report sent to CIBIL and cleanse the credit history…
It is likely that CC company may refuse…
In that per facts of your matter/deficiency on part f CC company you may have to get order from BO or Consumer Forum…
Get in touch with a very able senior LOCAL counsel of unshakable repute and integrity specializing in such/consumer matters and having a successful track record ……..and worth his/her salt…
Check at LOCAL Consumer Forum for such counsels…

given facts indicate no hurdle in police verification.

Thanks for your response "Kumar doab". I wish to confirm that I did not recieve any kind of summons or notice from court as well as I did not receive any email or call from CC company in regards of civil suit. By my credit report I get to know that "suit filed(wilfully defaulter) and written off status is in my credit report. I am just assuming that suit filed means civil suit filed in the court for recovery that's what I think. Please suggest what does that mean? Moreover I already made settlement with th bank in this month and waiting for NOC.

Why to repeat?
Kumar Doab (Expert) 28 February 2018
Suit Filed; as already explained ask CC company in writing..

Settlement is adverse entry as already explained....
Despite NOC the status 'Written off' may remain per preference of CC company that sends report to credit Bureau's like CIBIL, EQIFAX, EXPERIAN, Master card Negative Feedback list ................and then internal records of CC company.

Usually IT is believed that the CC holder will come back to get the credit history cleansed and once again an amount can be asked from CC holder...

You erred 1st by defaulting and then not consulting a very able LOCAL counsel as explained above...

You may need direction/order from forum e.g; BO/DCDRF .....if CC company does not agree to cleanse the credit history...
Vineet (Querist) 28 February 2018
Thanks for response sir, I already confirm with the CC company they informed me in writing and verbally as well they did not file any kind of civil suit for recovery. Furthermore I agree that indeed it was my fault to default. But I will go with your advice. Thanks for your support

I agree with Mr.Kumar doab.

You are unnecessarily stretching the thread.
Sudhir Kumar, Advocate (Expert) 01 March 2018
If you have not problem that does not meant that you should imagine or crate one for the sake of free advise
Kumar Doab (Expert) 02 March 2018
Thanks for agreeing Ms. Usha Kapoor.
Kumar Doab (Expert) 02 March 2018
You have done well by posting the query and agreeing to that you must have avoided default.
If some LOCAL branch has posted in writing by email then get the same from HO of CC company also.

Verbal communications are difficult to prove.
Especially the CC companies who might be making software generate calls.

Repeating same story time and again is absurd, ridiculous and stupidity.
