We don't have any title deed other than Revenue records and registered mortgage deed. Can we claim declaration based on registered mortgage deed alone? Considering it is settled position Revenue records are not document of title. It is a Ancestral property

In the absence of a registered title document in possession of the mortgagor, the certified registered mortgage deed can be based on as documentary evidence in a suit seeking declaration of title to the plaintiff besides attaching revenue records to correlate the pleadings.

You may have to look for citation yourself based on the background facts and suitable to your situation. You may contact your own advocate who is handling the same and proceed as suggested
