Sharing of cost in housing society for internal leakage

There is some Internal Leakage from one bathroom in my flat and water is flowing down to below flats.
Society wants me carry out the repair and bear the cost.

I have not done any repair since the flat is purchased from builder. Wish to know this repair cost is to be borne entirely by me or has to be shared between me and below flat facing the problem.

You are liable to ensure that your flat cause no inconvenience to others.

1. "IF" the leakage originates from your Flat, THEN you need to FIX the same entirely at your Cost & Consequences, AS PER the rules of the Civic Authorities, ELSE there is Criminal Prosecution for the same.

2. AS PER the Society's approved bye-laws, You and the affected Flat owner have to share the costs of stopping the leakage.

3. WHEREAS, you should also consider to register a NAME for yourself, for all legitimate purposes. How long a person can go about without a name ????

Hi,

Thanks Hemant Agarwal Ji,

The relevant extract of Bye Laws of my Scoiety regarding Internal Leakage is as under,

All the repairs, not covered by the bye­law No. 158(a) shall be carried out
by the Members at their cost. The expenditure of the internal leakage due to
toilet, sink etc. should be borne by concerned flat holders, with intimation to
the Society.

In view of above whether cost need to be shared among flat owners that is flat from where there is problem and flat who is suffering from the problem. OR Cost need to be borne entirely by flat from where there is problem.
