Suit for vacation and permanent injunction

Sir,
I have filed one suit against my brother for suit for vacation and measne profits as I am the owner of the property by way of Registred Gift deed and he is into the possession with my permission. In the court in his w.s. He has stated that he is the owner by way of adverse possession and he has also let out the proprty to some students as PG . so now my query is Litigation takes very long time , Is there any way that I could stop him by letting the property and directed by court to deposit the amount of rentals if he would get by that property.Please help me and tell me under what provision i could file application or anything . Thanks in advance

Ckanta if u file suit in court of law for declaration and possession of property then u can get relief.

If u t able to establish prima facie that you are owner of the property then the court may consider ur prayer...otherwise you are already seeking mense profits....even if it is not granted at initial stage...you will get ur dues....once you prove ur case...

From when he is having possession of the property?

When you get the property in gift?

What steps were taken by you after receiving the property in gift to vacate him if he was having possession at that time?

Discuss with your lawyer who is well aware about the facts of case.
There is no need of forming an opinion and advise you qua subject matter by "some" other lawyer except it is FREE OF COST.

Your problem does not seem to be real one.

However, about your question, "Is there any way that I could stop him by letting the property" you may take temporary stay to stop him from letting, as based on your suit against him. But, nothing other than that, except on proof of ownership.
