Departmental enquiry

(Querist) 14 March 2016 This query is : Resolved
I am a Central Government servant. A departmental enquiry was initiated against me. All witnesses were examined. The IO has passed an order to submit the brief of PO within 10 days under copy to me. However, the brief was not served to me even after a lapse of 1 month. I am proceeding for a long leave. Does the inaction of the PO may help any manner. What happens if the PO does not submit his brief? What action shall I take further in the matter? Kindly guide me.
Sudhir Kumar, Advocate (Expert) 06 April 2016
since copy of brief has not been given to you for such a long then submit in writing to IO and submit your own brief (if he has not submitted to IO without giving copy to you).

an oversmart and inexperienced PO may be sending brief to IO without giving copy to accused. SOME GOVT EMPLOYEES ARE STILL LIVING IN 150 YEARS BACK.

if brief has been submitted to IO and you have not been given a copy then submit in wrting to IO and seek copy of brief.
