Construction of chawl room

Hi team,

First of all thanks to all our experts on this side who regularly comments and responds to the query asked by us.
I have one question that i stay in chawl room and we are carrying out consrruction and repairs to the same. Now one person comes and says i am the landlord of this place but he is not and he says to seek permission from them for construction and pay sum of amount to them. This is the third time we are repairing our room but now they are claiming as landlord. Even though if we carry out construction there are chances that bmc would demolish the structure. So is there a way by which we can sought permission directly from bmc for construction? Does permission is granted to built chawl room? My contractor says bmc doesnot give permission in written.

Please advice.

In addition to the above the land is slum declared. The landlord has no authority but they are enforcing every one to pay tax by their criminal status.

First --- It is governed by Slum Area Act 1971 if It is in Maharashtra

Second --- See Land Lord issue is different whether he is land lord on paper that is Property card or not , you require to check from city survey office

If his name is not on property card then you don't need to pay anything .He is taking hafta.

But if his name or his ancestor name like father etc. is there then he has right in land in spite it is declared slum area.

Don't remain in false impression. Many people have false impression regarding Declaration of slum area that once slum area declared so previous land owner has no right . Yes he has right unless until land is acquired under provision of land acquisition act and redeveloped by concern authorities.

Third --- You should take permission from slum department to repair your hurt or house . And this permission you require to take before repairing. You ask at same place where you pay seva shulka
