(Querist) 11 April 2015 This query is : Resolved
Hi

we have grand father property which is on the name of my father, my self, my brother name.
i have 2 sons and 1 daughter. i have some personal problems to register my share to wards my sons ( excluding daughter). as my property is ancetral my daughter has some share in it. i dont want to put my sons under legal issues in future. i want my daughter to release her share in this ancetral property. with out registring my property to my name and then my sons name from my will.
is there any direct way legally accepted to release the share in ancetral property.

YOU CAN MAKE will on your own property only. i mean your self acquired property..

since the property is ancestral, you can make WILL just for your share only. your children got share by birth..

your daughter may release her rights after her majority age(18 years)

Who purchased the property and how it was transferred in the name of your Grand father? How his property came in the name of your father?

Better consult local lawyer and show him related documents.

it is not ancestral property . you can execute will bequeathing your 1/3rd share in name of your sons if you so desire .

This does not seems to be ancestral property. However, a proper opinion can be given only after seeing the relevant documents, hence consult a local advocate and get all the issues clarified personally.
