About your query, "I have around a Months Earned Leave. if i am going for studies without informing the Mgmnt and joining back after 8months will they be able to take any action against me," you would be treated as absconding from duty. You would be liable to be proceeded for indiscipline for unautorised absence from duty during the course of your absence or even after reporting back for duty. You will have to appear in the departmental inquiry to defend yourself to the satisfaction of the Inquiry Officer, otherwise inquiry can be made ex-parte in your absence leading to award of penalty of dismissal from service.

So, as a safe way, it will be better for you, if you make frantic efforts to get your study leave sanctioned before start of your studies abroad. If not possible, get your earned, half pay leave and leave without pay sanctioned before leaving for abroad. Later on earned leave and/or other kinds of leave so granted can be cancelled or converted in to study leave, if approved by the management during your leave period.

Make personal efforts by meeting the seniors to sanction your study leave. You can be dismissed if you proceed without leave sanctioned.

Dear Sirs,
Thank you for your replies. My file is held up at an HR desk where the officer is refusing to sign and take a descision. No comments or reply is being made regarding whether my leave is rejected or accepted. In such a scenario what is the best step forward.
rakeshsasi (Querist) 23 January 2015
The Officer is asking me orally to resign and gonfor the studies but is not ready to give a written communication in this regard with reference to my application letter wether the leave is accepted or rejected.

Adopt the way I suggested and after that remind authorities from time to time to sanction your study leave.
