Land grab

I am from Uttar Pradesh. The farm land in my name has been grabbed using criminal force and is being cultivated by certain people. Under which sections of IPC & other acts this crime will fall? Please explain.

Sir, the police are saying that this is a civil matter so we cannot file the complaint. That's why I want to know under which sections its a criminal offence. Cant we approach NHRC in the matter?

you go to nearest court and meet a lawyer or told him to file Sec 144 and or title suite.

The grabbers r so clever that if case is filed in court they would ple to the court that they have nothing to do with the property &las its not them but their contractors who cultivate it. Any more suggestions please?

File a suit and pray for mandatory injunction to evict the encroachers. You can also file Land Grabbing case against the encroachers.

In addition to that you can file a criminal case under Criminal Trespass. The police will call both the parties and see their documents. If your documents are genuine. The police will file Criminal case. If police is not responding, you can file private complaint by hiring an experienced lawyer. A case for criminal trespass; a case for land grabbing; a case for mandatory injunction; a case for eviction; All these are legal actions. If the police is not responding, you may file an application in the jurisdictional magistrate court u/s 156(3) of cr.p.c. for getting a direction to concerned police to initiate appropriate legal action against the culprits.
