Court fees

(Querist) 31 March 2014 This query is : Resolved 
I am asked two prayer in my case one for declaration of title and another is declaring that the sale deed null and void. I am paid court fees 75.50 for first prayer, and aim paid the court fees for half of the market value u.s. 25(d), I have not a party in the defendants sale deed. Court fees examiner given check slip to me pay the court fees for present market value. Hence aim consult the senior counsel and delete the prayer for sale deed in favour of the defendants null and void. Now the suit is maintainable or not.

Court fees differ from state to state. In WB no such curt fees is required which is on market value of the property.

When you seek to declare a document "NuLL and Void" you are to pay court fee on value of subject matter but for the same document if you pray to grant an injunction that "the document should not be enforceable against your property and against interest of you" the same is not chargeable ad volerem (at market value).

Likewise declaration required ad volerem court fee but the same thing is asked by way of injunction it may not require so.

It depends upon the relief and skill of drafting a plaint.

It is advisable to hire a good CIVIL LAWYER having practice more than 15 year in CIVIL side.

I think you are referring to the TNCF Act (?), if you are in doubt about the court fee, please consult a senior counsel well versed in civil matters available locally and get further clarifications in the subject.
