Land Acquisition Act, 1894 - Section 4(1)
Governmnet Not issued notice under same section .

they had been acquired in 1962. untill today not using for the which purpose .

Kulsum R. Nadiadwala Vs. State of Maharashtra & Ors. can we claim for the return land on the above judmgnet basis?

any limitation act obsrutction in this matter?

If state is just in the possession without acquiring the land as per due procedure, no limitation shall come in the way for the claim of the land by the true owner.

If the land is acquired for any purpose, if the land use not used for that particular purpose, you can claim restoration of titles through a writ petition in High court.

Dear Sir,

It is to be noted that when a land has been acquired for a purpose and the same has not achieved then as per the new land ordinances it shall vest back to the land owner if actual possession is not taken or compensation has not been paid. in case compensation has been paid and possession has been taken then the land may go to the land bank of the Goverment
