Crpc125- calling witness

(Querist) 18 September 2013 This query is : Resolved

Dear Experts

It is an M.C case by wife filed after divorce u.s crpc 125. Husband filed counter, now date for cross exam on wife fixed.so far wife has not furnished list of witness from her side. meanwhile, husband has applied thro RTI and got information about wifes education /employment /properties....

But the reply from her employer is incomplete in which employer revealed HER NAME IN LIST OF EMPLOYEES AND PURPOSELY GIVEN WRONG DATE OF JOINING......( I.E LOGICALLY INCORRECT DATE OF JOINING)... Being so,i want to utilise this RTI reply during cross exam effectively.... now my questions are:

1. Can i directly ask the court to permit me to invite the employer for witnessing?

2. can i show this incomplete reply itself to court during cross exam and expect wife to admit her employment?

3. I being respondent, if i have to call witness thro court, what is the procedure to be followed and under which section to apply?

4. While cross exam, can i ask Petitioner (wife) reg... whetehr she has furnished any list of witness so far?

5. any other views pls

Dear Querist
my reply on your queries are as under
1. Can i directly ask the court to permit me to invite the employer for witnessing?
Opinion: you should file list of witness from your side in which you can add her employer name.

2. can i show this incomplete reply itself to court during cross exam and expect wife to admit her employment?
Opinion: yes, you can but if you think that this document is useful for you then only file this document otherwise not.

3. I being respondent, if i have to call witness thro court, what is the procedure to be followed and under which section to apply?
Opinion: file a list of witness & approach to court to issue summons to witnesses.

4. While cross exam, can i ask Petitioner (wife) reg... whetehr she has furnished any list of witness so far?
Opinion: yes you can, its your right to ask.
