False affadavit of notary in probate petition

(Querist) 03 August 2013 This query is : Resolved
Respected Sir,
There was a will dated 29th August 2006 and notarised on 30th August 2006.But the said notary,in his statement to the police has said that he was not a notary in 2006 and he got the license of notary in 2008.Also the notary has denied his signature on the will stating that he was not registered as a notary in 2006.
Also there was an affadavit of the notary in probate petition without his signature. The said affadavit stated that the deceased went to the notary on 30th August 2006 and after all identification, the notary signed the will. However the notary has now clearly denied the contents of the affadavit and he also states that he never met the deceased as he wasn't a notary in 2006.
The HANDWRITING EXPERT of C.I.D have given their report that the signature of the deceased on the will are not natural(not the deceased signature)
Now we are planning to file a case in HIGH COURT against the executor. The case will we regarding the affadavit of the notary without his signature and also against the false contents of the affadavit.
So i would like to know what section of IPC is applicable on the executor as he has submitted a forged affadavit without the notary's signature for probate petition and what is the punishment for this.
