Salary disclosure

(Querist) 20 February 2013 This query is : Resolved
Hi Sir,

I am wrongly charged under DV case which is pending since last 2 years and now the time has come for my cross (as I have submitted my evidences).

Therefore I just wanted to know, in this cross does against Adv allowed to ask a question about my current salary. If yes, then what should I reply on that question.

Why I feel as no because this is the only case of DV not under section 125.

Just to add that I have already submitted one affidavit stating that my Salary is around 15K (before some time when she asked for interim maintenance) but in petition my wife just mentioned that I have a package of 13 lakhs per annum but she did not submit any proof for it.

The wife may summon your company official in proof of your salary. SO you better state the truth.

I hope that you would have disclosed the truth in your affidavit.

Te counsel for your wife has very right to cross-examine you on all facts of the case irrespective of the fact whether the issue of the salary is the part of your pleadings or not. It is better to always speak truth before court especially when a documentary evidence can be brought at any time by opposite party in that regard.

in X opposite adv.can ask anything from u.
Sudhir Kumar, Advocate (Expert) 21 February 2013
asking some question which y9ou may feel irrelevant is a good ploy to annoy you in court and prove you to be stubborn. Be careful.

On oath you are bound to state truth.
