Bonus to employee- resigned

(Querist) 12 November 2012 This query is : Resolved
Sir,

I work in a small size pvt co. registered under companys act.

The employer pays bonus to the employee every year though they do not compliance with the Bonus act Strictly.

Bonus is usually paid on Diwali.
Due to some reason i had argument with my employer on minor issue where he spoked to me very arrogantly even after serving the company for 7 yrs.

So i decided to leave the company giving one months notice. ie on 30.9.12.

I had written to the company for my yearly Bonus( FY 2011-2012) . But no reply.

My question is can i claim bonus if paid to the present employees.

Pl reply

what was your last salary ?

You can claim pro-rata bonus for the period you worked in the accounting year. Make a complaint to Labour commissioner/ Authority under the payment of bonus act if it is not paid.

Dear Mr.Poorna
So,you are not eligible for bonus under the payment of bonus act.
Poorna (Querist) 17 November 2012
Sir,

Bonus is paid irrespective of any salary.
Even the employee earning rs.27,500/- has received bonus. This company do not adhere to Bonus Act strictly since this is a small size company as stated earlier. Then why can''t i ask for my bonus rights.

Your Boss's Pleasure....
Keep him Happy, he may please on you & pay Bonus.

If you fight, & leave him, He can say Bye-Bye--Happy Diwali to you.. No Bonus.

No liability to pay you..
